A prisoner need not obtain any permission from any court once he obtains custody parole in a case: Delhi HC.

The Delhi high court stated that if a prisoner once obtains a custody parole in a case need not to obtain it from every other court where he is either convicted or there is a trial pending against him.

The decision came in when the former MP Mohd. Shahabuddin filed a plea for a parole to meet his family and perform rites on his father’s grave, the petitioner is serving a life term in Tihar jail.

As he was in judicial custody for many offenses, the court stated the above order and on the question about whether he will be regulated under Delhi jail rules or Bihar, the court stated that as he was in Delhi for a long time he must be regulated under Delhi jail rules.

The court relied on an earlier judgement in court on its own motion v. state, also the court provided various guidelines for the custody of parole.
