Convicts of POCSO not to be entitled under COVID-19 parole: Bombay HC

The court dismissed a petition filed in the Bombay High Court seeking parole under emergency for COVID-19; it convicts the accused under the POCSO Act. The bench took Sardar s/o. Shawali Khan vs. the state of Maharashtra case’s reference in which the petitioner was trialled under various provisions and, the court said the prisoners who are involved in serious crimes such as NDPS, rape, are not entitled to get the benefit of parole.
The court also stated that earlier the category of the pandemic was not there but because of COVID-19, the prisoners can get parole in this kind of emergency. However, the court also said that such parole is subject to conditions and because of which the petitions were rejected.
