Delhi HC: Imposed 5K on Superintendent for not submitting the medical report of the asthma patient

The Delhi HC on Thursday (8th October) with the bench of Justice Suresh Kumar Kait imposed a cost of Rs.5,000/- to be recovered from the salary of jail superintendent concerned and paid in the account of “Bharat ke Veer” within one week from receipt of this order. Has the superintendent failed to comply with the court’s order dated 17.09.2020 whereby he was directed to send a medical report if the petitioner was suffering from asthma and treatment being given to him in jail in this regard. This petitioner was filed under section 439 with regard to section 482 of Crpc the petitioner is suffering asthma from so long in jail and living with the help of medical pump and he was needed to check-up his lungs and respiratory organs as he may have coronavirus so the court granted him interim bail for 45 days and he was directed to release on the bail on his furnishing personal bond in the sum of Rs.15, 000/- with one surety for satisfaction to trail court.
