3rd November, 2020
Even when the bail is granted by the trial court to Farooq the Delhi high court denied the bail to the accused, convicted for promoting riots in the north-eastern region of the state. The accused owns two schools in Delhi which he provided to the rioters to promote the riots, he is also been accused of providing the material for destruction.
The trial court allowed him the bail on the facts provided to it but the court failed to delve deeper into the matter which the high court didn’t and looked from both sides and it decided that the accused is having a greater position in the society which can affect the investigation of his case and along with the other cases related to the riots as he carries that reputation and power in the society.
The high court even said that when it comes to matters of larger public interest then personal liberty values little before that as the fundamental rights are not absolute and hence, Faisal Farooq was denied bail.
