Delhi High court seeks the ED response in ICICI Videocon case

The Delhi High Court on Thursday sought the response of enforcement directorate to a plea made by Deepak Konchar in ICICI Videocon case under money laundering act. The petitioner was represented by Sr. Adv. Mukul Rohatgi while the enforcement directorate was represented by Adv. Amit Mahajan. The court passed an order to ED on jurisdictional maintainability of the current writ petition challenging arrest of Deepak for interim relief of bail. Mr. Deepak was arrested in the ICICI bank Videocon loan fraud under prevention of money laundering act. And was remanded to ED’s custody till September 19, 2020 by special court in Mumbai. Adv. Amrit Mahajan informed the court the recent judgement passed by the PMLA court he relied on the on judgement of SFIU V. Rahul Modi argued that Delhi HC had no jurisdiction in the present matter. And he argued as per the case Vakamulla Chandrashekhar v. ED would prevail in the absence of any other authorities by any application of chapter 12 of Cr.P.C to PMLA and communicating grounds of arrest is concerned. He also argued about the relief bail and said that it was illegal and bail was sought as an interim relief by saying that it is not by Article 226 of constitution. The court said that after hearing Justice Bhambani passed an order for filing of status report by ED and posted for next hearing.
