Delhi riots and damaging of Fatima Masjid accused were denied bail by Delhi sessions court

The Karkardooma Court (Delhi), Additional Sessions Judge Vinod Yadav, dismissed a bail plea of one of the Delhi rioters in the case of causing damage to the Fatima Masjid situated in North-East Delhi, Khajuri Khas, C-block, Gali no. 29. While doing so, the judge observed that it was the applicant's fifth bail plea and he has yet to show any change of circumstances in his case. Further, based on the arguments put forth by the applicant’s counsel, the bail plea failed to distinguish between the role of the applicant from of co-accused Mithan Singh, whose bail application has already been dismissed. Also, there has been no record of any material to show prima face, that the applicant was not present at the scene of the crime on the date of the incident but was instead present at his workplace. They failed to even mention the address of the workplace of the applicant in the bail plea.
Hence, considering the gravity of the allegations and the large-scale involvement of the applicant in the cases of riots, the judge deemed it as an act against the country’s secular structure and accordingly unfit for bail.
