5th November, 2020
Supreme Court in a judgment has directed that affidavits of disclosure of assets and liabilities shall be filed by both the parties in all maintenance cases, also pending cases related to that before the concerned court. The parties which belong to economically weaker sections and below the poverty line and others will be provided with the required affidavits.
The pleadings and applications must be genuine and should contain accurate information. The court has also directed different kinds of applications for non-agrarian and agrarian deponents separately. The court has also directed that both parties must not hide any details and important information in their applications.
The apex court has also directed different models of affidavits for tribal states such as Meghalaya where matrilineal society is present. Guidelines for payment of permanent alimony are also given by the Supreme Court and also requested that if proceedings other than the present institution have taken place earlier must also be informed so that the matter could be resolved more appropriately by the court.
