Illegal Eviction from house by son former HC judge moves to Allahabad HC.
17th October 2020
The Allahabad HC on Thursday with the bench consisting of Justice Shashi Kant Gupta and Pankaj Bhaita directed the District Magistrate, Prayagraj, to resolve a property title/possession dispute between a former judge of Allahabad HC and his son, within two months.
The judges directed the magistrate to pass a “speaking and reasoned order” and further granted liberty to the parties to place the order before the court, for further directions. The order has come in the writ petition filed by the Justice Anjani Kumar and his wife that their son Chandra Shekar illegally evicted them. They sought protection under the Uttar Pradesh Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and Maintenance and Welfare of Parents and Senior Citizens Rules, 2014.
In the case the petitioners feel aggrieved with the order of the District magistrate, they have granted the liberty to place a copy of the said order before this court for perusal and passing of further orders. The court does not grant any interim bail. And listed orders for Feb, 8, 2021.
