Madhya Pradesh HC: register Suo Moto petition against MLAs/MPs on criminal cases

The Madhya Pradesh High Court (Jabalpur bench) registered a Suo Moto petition on 21/09/2020 for monitoring the progress of the trails of the pending cases against sitting former MLAs/MPs in compliance of the order of the Supreme Court dated 16/09/20 passed in WP. (Civil) No. 600/2016(Ashwini Kumar Upadhyay and others vs. Union of India and others). And the Chief Justice Ajay Kumar Mittal and Justice Sanjay Yadav on Tuesday issued notice namely:
1. Union of India through secretary, department of Justice, Ministry of Law and Justice, New Delhi;
2. The state of M.P through the chief secretary, Vallabh Bhawan, Bhopal.
3. High Court of M.P Jabalpur through the registrar general
4. The principal secretary, Department of Law and Legislative affairs ,Government of Vallabh bhawan, Bhopal(M.P)
With an aim to enable “timely action” in criminal cases pending against sitting MLAs and MPs, the HC of Manipur on Thursday (Oct 1st) directed the state governments to create the “exclusive special courts”. And said to take an initiative in the “safe and secure witness examination room” and video conference in courts to aid and assist the early and speedy trials. The Orissa HC also directed the state Government to take action.
