Madhya Pradesh HC grants 2 - month bail to Rape accused to marry complainant

The MP High Court on Wednesday (02nd September) granted two month bail to a man marrying a women who was constantly getting raped by this man. A single bench of Justice S.K Awasthi said the accused was arrested on February 12 for allegedly repeatedly raping a woman, criminal intimidation and under the Schedule Tribes and Schedule Castes (Prevention of Atrocities) Act from Devas district. Prosecutrix's (women) statement which was recorded under section 164 of CrPC had said that she was having an affair with the man (appellant) and had physical contact every day. On the insistence of the appellant, she divorced her husband and thereafter he (appellant) refused to marry her. "In this circumstance, the appellant is granted a temporary bail for a period of two months so that during this period he can solemnise with the prosecution".
