Supreme Court challenged by CPI (M) leader Tarigami for order allowing outsider to buy land in J&K.

Veteran CPI (M) leader Mohammed Yusuf Tarigami challenging the recent order of the union minister of Home Affairs, which allows outsider to buy land in territory of J&K including agricultural land, has moved the application in the writ Petition in Supreme Court.
The application stated that the matter related to land use, transfer thereof and the broader matter related to revenue etc. we were well within the power of state tell the presidential order dated. Further, the special historical circumstance the application stated that several constitutional provisions existed to safeguard the distinctive rights an identity of the region’s permanent and local residents. The notification of MHA is illegal, as it has been issued in of power under section 96 of the J&K reorganization act.
The application concludes, “If the decommissioning of the Article 370 and 35A are unconstitutional, therefore, the application seeks for a stay on the 26th October notification till the disposal of the writ petition.
